1) Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of ApplyGhost's websites, dashboard, APIs, and browser extension (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2) Who We Are

ApplyGhost ("we", "us", "our") is a software service that assists users with job discovery and application workflows, including automation features that operate based on user configuration.

3) Eligibility

You must be at least 18 years old to use the Services.

By using ApplyGhost, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and up to date

4) Description of the Services

ApplyGhost provides tools to help users discover relevant job opportunities and manage job applications. Depending on user settings and subscription plan, the Services may:

• Surface job matches based on user-provided criteria
• Queue applications for automation
• Fill application forms using user-provided data
• Attempt submissions through supported workflows
• Log and display outcomes such as applied, skipped, or failed

The browser extension will never submit applications without explicit user authorization. Final submission is always controlled by the user.

5) User Responsibilities

You are solely responsible for:

• The accuracy, legality, and completeness of all application data and documents
• Reviewing application content before submission
• Complying with employer, recruiter, job board, and ATS terms and rules
• Ensuring that use of automation is permitted by third-party platforms

ApplyGhost does not review, verify, or guarantee the correctness or suitability of any application content.

6) No Guarantee of Results

ApplyGhost does not guarantee:

• That applications will be successfully submitted
• That job portals or employers will accept applications
• That you will receive interviews, responses, or job offers

Automation may fail due to external factors including website changes, captchas, technical limitations, or third-party restrictions.

7) Subscription Plans and Limits

ApplyGhost is offered via paid subscription plans with defined monthly limits.

• All limits are hard limits and cannot be exceeded
• Unused applications do not roll over to the next billing period
• Limits reset at the start of each billing cycle

Attempted, skipped, or failed applications may still count toward plan usage depending on system behavior and logging.

8) Payments and Billing

Payments are processed through third-party payment providers such as Stripe.

By subscribing, you authorize recurring charges according to your selected plan until you cancel.

No free trials are offered.

9) Refund Policy

Subscription fees are generally non-refundable.

If you have already used any portion of your plan (including application attempts or matches), you are not eligible for a refund.

Any exceptions are granted at ApplyGhost's sole discretion.

10) Account Suspension and Termination

ApplyGhost may suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms
• You misuse automation or the browser extension
• You violate third-party platform rules
• Your activity poses legal, security, or operational risk

Severe cases may result in immediate termination without prior notice.

11) Third-Party Services

The Services rely on and integrate with third-party providers, including but not limited to:

• Payment processors (e.g. Stripe)
• Email providers (e.g. Google/Gmail, if connected)
• AI and automation providers (e.g. OpenAI)
• Job boards and applicant tracking systems

ApplyGhost is not responsible for third-party services, availability, or policies.

12) Email Integration

Email integrations are optional, user-initiated, and may be revoked at any time.

ApplyGhost only accesses email data within the scope explicitly authorized by the user and for features enabled by the user.

13) Intellectual Property

All intellectual property rights in the Services, including software, branding, and content (excluding user content), belong to ApplyGhost.

You are granted a limited, non-exclusive, non-transferable right to use the Services during your subscription.

14) Limitation of Liability

To the maximum extent permitted by law, ApplyGhost shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of income, employment opportunities, or business
• Data loss caused by third parties or external systems

ApplyGhost's total liability for any claim shall not exceed the amount paid by you to ApplyGhost in the three (3) months preceding the claim.

15) Disclaimer

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

ApplyGhost disclaims all warranties, including fitness for a particular purpose and non-infringement.

16) Governing Law and Jurisdiction

These Terms are governed by the laws of the European Union, excluding conflict-of-law rules.

Any disputes shall be resolved in the competent courts within the European Union.

17) Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
